Polderburn is a game in development. Race for free or support development with a one-off purchase of lifetime Early Access. Below, we explain what you receive, what may change and when a refund may apply.
You pay the total price shown in advance once, including VAT. The regular price is €13.99; a temporary offer may reduce it.
There may be bugs. Roadmap ideas and timing may change and are not fixed delivery promises.
These terms do not restrict any rights guaranteed by mandatory consumer law.
Who provides Polderburn?
The game is offered under the trading name Polderburn, registered in the Dutch Trade Register under Chamber of Commerce number 77200799. For questions, complaints and requests, email [email protected] or use the contact form on the homepage.
These terms apply to the website, free demo, accounts and paid Polderburn Early Access. The agreement is in Dutch. This English translation is provided for your convenience and does not change your statutory rights.
Playing for free and entering into a contract
The trial is free. For lifetime Early Access, the paid contract is formed when, after being shown the price and these terms, you press the button indicating the obligation to pay and Stripe accepts the payment.
If you are under 18, only purchase with permission from a parent or legal representative. A parent or representative may contact us about an unintended purchase.
What do you buy with Early Access?
The one-off purchase supports further development and grants access to the paid Polderburn content available at the time of purchase. Without a new subscription, you also receive access to Polderburn content that we actually make available later within this Early Access release. This currently includes additional stages and cars, a gamertag, a personalised number plate and leaderboard participation.
You are not buying a finished game or a fixed roadmap. Ideas such as career mode, ghost racing, CPU racers or multiplayer describe our direction. Content, order, technology and timing may change. A separate sequel, spin-off, third-party expansion or new product is not automatically included in this purchase.
“Lifetime” means access for as long as Polderburn is actively offered by the provider or a legal successor. It is not a guarantee that the service will remain online for the buyer’s lifetime, forever or until a particular date. If termination or a change affects your statutory rights, those rights remain fully applicable.
Early Access means development
Polderburn is still being built. You should therefore expect changes, temporary errors, incomplete features, balancing adjustments and maintenance. We do not promise error-free or uninterrupted operation, a fixed framerate or delivery dates for roadmap features.
This does not mean anything goes. The paid digital content must continue to meet what you may reasonably expect based on the price, product page, system requirements and explicit agreements.
Account and personal licence
You receive a personal, non-exclusive, non-transferable right of use for private purposes. Selling, renting, sharing paid access, cheating, manipulating times, reverse engineering beyond what the law permits and bypassing security are not allowed.
Keep login details secure and report suspected misuse. Gamertags, number plates and other public profile text must not be unlawful, discriminatory, threatening, misleading or infringe rights. We may edit or remove such text.
System requirements and your environment
Polderburn runs in the browser and uses modern GPU technology. Current requirements are shown on the website before purchase. Use an up-to-date supported browser, enabled hardware acceleration, a suitable GPU and a stable internet connection. The free demo lets you test performance on your own device before buying.
For a technical issue, we may ask for reasonable diagnostic information and cooperation using the least intrusive available method. We do not ask for passwords. An issue caused solely by an unsupported environment, disabled hardware acceleration, user modifications or failure to install a clearly announced necessary update is not automatically our responsibility.
Availability, maintenance and changes
Maintenance, security updates, game balancing and technical changes may temporarily affect availability or operation. We may change the game for valid technical, legal, security or gameplay reasons, at no additional cost to existing Early Access members.
For a materially adverse change, we will inform you appropriately and respect any statutory rights that arise. We may discontinue a feature where reasonably necessary, but no provision in these terms can exclude mandatory rights.
Price and payment
The regular price of Lifetime Early Access is a one-off €13.99 including VAT. During a temporary offer, the promotional price and fixed deadline shown on the product page apply. The offer is not extended for individual visitors. Afterwards, the regular price automatically applies again.
This is not a subscription, and there is no recurring charge or renewal. Before confirmation, the product page, purchase button and Stripe display the amount applicable to your Checkout session. Access is granted only after Stripe confirms payment.
A separate contribution through the donation button is different. It is voluntary support with no game content, account status or other consideration in return. An Early Access purchase does provide that access and is therefore not legally a donation.
If you report a duplicate or demonstrably unauthorised charge, we will investigate promptly. Where possible, a refund is made using the same payment method.
Withdrawal period and refunds
An online purchase normally carries a statutory withdrawal period of 14 days. Because Early Access is digital content you want to use immediately, before Stripe checkout we separately ask for:
- acceptance of this version of the terms;
- your express request for digital access to be supplied immediately after payment;
- your acknowledgement that you understand the statutory withdrawal period ends once immediate access begins.
The boxes are never preselected. Your consent is also included in the purchase confirmation. If the legal conditions have been met and access has begun, you cannot cancel within 14 days solely because you changed your mind.
If the required consent or acknowledgement was missing, or digital supply has not yet begun, the statutory right of withdrawal may still apply. You can submit your notice using the form below or email [email protected]. You do not have to give a reason.
Apart from statutory rights, we may consider a goodwill solution in the event of a clear mistake, duplicate payment or exceptional situation. This is assessed individually and is not an automatic or ongoing refund promise.
If the game does not work properly
Digital content is covered by statutory conformity rights. Report a specific problem through the contact form and include your device, operating system and browser. We may first try to resolve it free of charge within a reasonable time, for example through guidance, a setting or an update.
If a remedy is impossible or disproportionate, is not provided within a reasonable time, the issue recurs or the issue is serious, you may be entitled to an appropriate price reduction or termination and refund. A minor defect does not always entitle you to full termination. This assessment follows the law, not just this text.
Misuse, blocking and termination
We may temporarily restrict access or leaderboard participation for fraud, payment chargebacks, cheating, security abuse, serious disruption to others or a clear breach of these terms. Where circumstances allow, we will explain the issue and give you an opportunity to respond or remedy it.
We may intervene immediately in the event of an urgent security risk or serious misuse. Blocking for attributable serious misuse does not automatically entitle you to a refund, insofar as the law permits.
Liability
Polderburn is intended for private recreational use. We are not responsible for business losses, lost income or damage that was not reasonably foreseeable when the contract was formed. We are also not responsible for disruptions demonstrably beyond our control, insofar as the law permits.
Nothing in these terms excludes liability that cannot legally be excluded, including liability for intent or deliberate recklessness, or your mandatory consumer rights.
Privacy, external parties and intellectual property
Our privacy policy explains which data we use. Stripe processes payments and Cloudflare handles transactional email. Their own terms and privacy policies apply to their services.
The software, design, brands, audio and game content remain the property of Polderburn or their respective rights holders. We may use feedback and ideas you voluntarily share to improve Polderburn without compensation. This does not give us ownership of your personal data.
New terms or a different provider
We may amend these terms because of changes in law, security reasons or changes to Polderburn. Less favourable terms do not simply apply retroactively to an existing purchase. For a material change, we will inform you and seek renewed consent where legally required.
If Polderburn is later offered through a sole trader or another legal successor, we will inform you in advance. Your existing rights must not be reduced. Where a transfer legally requires consent, we will ask for it.
Complaints and applicable law
First, contact us at [email protected]. We will review the issue and try to find a reasonable solution together. Dutch law applies to the agreement. Mandatory protection in the country where a consumer habitually resides remains applicable. Disputes may be brought before the court competent under the law.
Cancel a purchase or discuss a refund
This form officially records that you wish to terminate the agreement. If you still have a statutory right to do so, the submission time counts. If you have already agreed to immediate Early Access and loss of the withdrawal period, we will review your message as a request based on a technical issue, duplicate payment or goodwill. You do not need to create an account.
